Terms and Conditions

These terms are subject to change and will be updated as needed. You, the Customer (referred to below as “Customer) acknowledge that you have read the conditions below and agrees to abide by this agreement. SWDI Grading is entitled to rely upon and benefit from this agreement. SWDI Grading may be referred to in this agreement as “SWDI”.


  1. Customer Definition: Customers are those who can legally submit items to SWDI for grading and authentication. They must be at least 18 years old, or if under 18, have parental consent. If you are a parent or guardian of a minor using this site (or submitting items in person), you hereby agree to bind the minor to these terms and conditions and to fully indemnify and hold harmless SWDI if the minor does not follow any of the terms or conditions.
  2. Fee Changes: SWDI can change fees as needed and will bill at prevailing prices.
  3. Additional Charges: SWDI can add charges for various reasons like custom modifications or oversized items. Customer will incur and agrees to pay any additional fees related to extra insurance taken out by the Customer’s undervaluation of item(s).
  4. Altered and Counterfeit Items: Customers may not submit altered or counterfeit items. SWDI is not liable nor can be held liable for any damages or costs incurred from the grading of any altered or counterfeited items.
  5. Subjective Grading: SWDI's grading is done to the best of our professional opinions and ability. Grading and authentication is subjective and cannot be guaranteed.
  6. Liability Limitation: SWDI isn't liable for any incidental or consequential damages if items aren't graded within estimated timeframes. Customer waives all rights to seek incidental, indirect, or consequential damages against SWDI.
  7. New Information Impact: SWDI is not liable for changes in item value after grading due to new information.
  8. Error Corrections: SWDI will correct errors in grading, labeling or authentication at their expense. Customer agrees to check items for any errors within 7 days of receipt of item, and to notify SWDI of any errors found. SWDI is not liable for errors for any items that customer re-sells if not notified and given reasonable time to correct said errors within the 7 day time frame of receipt of said item(s) by Customer.
  9. Image Use: SWDI can use images of submitted items for commercial purposes.
  10. Loss or Damage: SWDI is not liable for loss or damage unless it occurs while items are in their possession. SWDI agrees to replace said items with comparable items of equal or greater value, or to compensate at the amount determined by SWDI based on that item’s median value at the time of loss or damage. Any damage or loss of items incurred from shipping to or from SWDI will be paid by SWDI. Customer agrees to be compensated by the shipping entity if and when the shipper determines such compensation. Customer agrees to purchase insurance for at least the value put on their items from the shipper. Any items lost in shipping that were not properly insured come at loss to customer. Items received at SWDI will be checked against the list(s) provided by Customer. If items received at SWDI are missing from the itemized declaration or do not match the Customer provided information, Customer will be notified and Customer agrees to not to hold SWDI responsible for these lost or damaged items.

    SWDI will use reasonable care in handling items submitted for grading and/or authentication, review, or re-casing. However, if Customer’s item was lost or damaged while in SWDI’s possession, Customer will be compensated based upon the fair market value of the item as determined by SWDI’s standard procedures which may include filing a claim with our insurance carrier. The declared value you stated on for submitted item(s) is for estimating the insurance coverage only, and the fair market value of the item may be less than your declared value. IN NO EVENT SHALL THE TOTAL LIABILITY OF SWDI, ITS AFFILIATES OR ANY OF SWDI OWNERSHIP, EMPLOYEES, AGENTS, PARTNERS, SUBSIDIARIES, DIVISIONS, SUCCESSORS, SUPPLIERS, DISTRIBUTORS, AFFILIATES, VENDORS, CONTRACTORS, REPRESENTATIVES OR CONTENT OR SERVICE PROVIDERS EXCEED THE GREATER OF: (I) THE FEES PAID TO SWDI FOR GRADING ANDOR AUTHENTICATION OF AN ITEM, OR (II) THE NET PROCEEDS OF INSURANCE (LESS ANY DEDUCTIBLE PAID BY SWDI). Such compensation shall be Customer’s exclusive remedy for any loss or damage.
  11. Case or Holder Issues: SWDI is not liable for any damage to items if a broken or defective case/holder is submitted. Any items submitted in packaging or cases that cause damage to that item when removed from the packaging or case are the responsibility of the Customer. Case “breaking” comes with risk of damage to item(s).
  12. Fraudulent Items: SWDI can remove fraudulent items from their holder without notice.
  13. Care Responsibilities: Customers must handle graded items carefully as holders are not waterproof or UV-resistant. SWDI is not liable for any damage to case or item after the item has been received by customer.
  14. Liability Cap: SWDI's liability is limited to the fees paid for grading or authentication.
  15. Exclusion of Damages: SWDI is not liable for certain damages or circumstances, even if advised of the possibility.
  16. Warranty Disclaimer: SWDI disclaims all warranties except as expressly stated.
  17. Data and Image Usage: SWDI owns all data and images of graded items and can use them as they see fit.
  18. Third-Party Agreement: If items are submitted on behalf of a third party, the third party must agree to these terms.
  19. Indemnification: Customers must indemnify SWDI against any losses or claims arising from their submission or breach of the agreement.
  20. Governing Law and Jurisdiction: Disputes are governed by Utah law, and parties agree to the jurisdiction of Utah courts.
  21. Entire Agreement: These terms constitute the entire agreement between SWDI and the Customer.
  22. Service Refusal: SWDI reserves the right to refuse services for various reasons.
  23. Transactional Communications: Customers consent to receive transactional emails, phone calls and/or texts from SWDI.
  24. Personal Information Sharing: SWDI may share personal information with third-party vendors for order fulfillment.
  25. Ownership and Trading: SWDI's owners and employees can submit items for grading and trade them freely.
  26. Privacy Policy: All information collected is subject to SWDI's Privacy Policy, and by using their services, Customers agree to its terms.Top of Form Our Privacy Policy may be accessed here.
